General Participation Terms for Workshops and Seminars
These terms govern bookings and participation in paid and free EnergoInformatics events.
1. Provider and scope
These terms apply to workshops, seminars and comparable events offered by Oleg Fallmann, trading as “EnergoInformatics”, Danziger Str. 9, 66121 Saarbrücken, Germany, info@energoinformatics.com. Individually agreed terms take precedence. Purchases from external bookshops are governed by the shop’s own terms.
2. Nature of the events
The events are intended for self-experience, relaxation and personal development. They are not medical, psychotherapeutic or healing advice, diagnosis or treatment and do not replace such services. No specific health, financial or personal outcome is promised. Exercises are voluntary and undertaken on the participant’s own responsibility; participants may pause or omit an exercise at any time.
3. Booking and conclusion of contract
Event descriptions are not binding offers. The booking dialog displays the event, date, price and any deposit. For paid events, the contract is concluded when payment or the deposit has been completed successfully and the booking is confirmed. For free events, the contract is concluded upon booking confirmation. A preliminary automated message only confirms receipt of booking data.
Booking information must be complete and accurate. Anyone booking for another person must be authorised and must pass these terms to that participant.
4. Prices and payment
The price shown for the specific event applies. Where the German small-business VAT rule is used, VAT is not shown separately. If a deposit is offered, the place is firmly reserved after receipt of the deposit. The balance is due on the date stated in the confirmation and, unless stated otherwise, no later than three calendar days before the event. Payments are processed by Stripe.
5. Participation and conduct
Participants must follow safety instructions, treat others respectfully and avoid disruption. Participation while materially impaired by alcohol or intoxicants is not permitted. Minors may participate only with prior approval and consent of their legal representative unless the event is expressly intended for minors.
6. Reasonable changes
Reasonable changes to schedule, room, start time, trainer or individual content are permitted if the overall character remains unchanged. In the event of a material change, the participant may withdraw without charge.
7. Cancellation or postponement by the organiser
EnergoInformatics may cancel or postpone for good cause, including illness, venue failure, insufficient enrolment or force majeure. Fees paid are refunded in full if cancelled. If postponed, participants may attend the replacement date or request a refund. Travel and accommodation costs are reimbursed only where required by law.
8. Participant cancellation
The separate cancellation policy forms part of these terms.
9. Exclusion
Serious or repeated breaches of safety instructions, respectful conduct or orderly operation may lead to exclusion after a warning. Statutory rights remain unaffected.
10. Materials and recordings
Materials are for personal use only. Copying, distribution, publication or commercial use requires prior permission. Photos, audio or video recordings require prior consent of EnergoInformatics and all identifiable persons.
11. Confidentiality
Personal contributions of other participants should be treated confidentially. The organiser can request this but cannot guarantee the conduct of other participants.
12. Liability
Liability is unlimited for intent, gross negligence, injury to life, body or health and mandatory statutory liability. For slight negligence in breach of essential contractual duties, liability is limited to foreseeable damage typical of the contract. Otherwise liability for slight negligence is excluded.
13. Privacy
See the privacy notice.
14. Consumer dispute resolution
EnergoInformatics is neither obliged nor willing to participate in consumer arbitration proceedings.
15. Law, language and validity
German law applies, without depriving consumers of mandatory protection in their country of residence. German is the contract language. Translations are provided for convenience; the German version prevails. If a clause is invalid, statutory law applies.
